1. Criminal law — Effect of testifying before Grand Jury. An information filed by county attorney against defendant by leave of court before impaneling of grand jury before whom defendant thereafter appeared and voluntarily testified was not subject to dismissal by reason of defendant having given testimony before grand jury, where defendant made no objection to being sworn or to testifying before grand jury on account of privilege. 2. Criminal law — Failure to prosecute before six months. Where defendant filed motion to dismiss information on two grounds, the second of which was that defendant had not been brought to trial within six months after filing of information as required by statute providing that trial court, unless good cause to contrary is shown, must dismiss prosecution against defendant not brought to trial within six months after filing of information, and record did not show whether second ground was urged at hearing on motion, and courts order of dismissal failed to show any ruling on such ground or whether such good cause existed, statute did not render defendant immune from prosecution under the information.
